Article 1: Companies organizing the game

The company SYMMETRIC (hereinafter, “the Organizing Company 1”), a simplified joint stock company with a share capital of 1,338.90 euros, whose registered office is located at 111, avenue Achille Perreti, registered in the Nanterre Trade and Companies Register under number 839 442 258.

SYMMETRIC is organizing a free game with no obligation to purchase entitled “ba&sh x The Bradery” (hereinafter, the “Game”) from 11/28/2023 at 6 p.m. to 12/01/2023 at noon (hereinafter, the “Game Duration”), and accessible at the following URL address:

Article 2: Consultation of the game rules

The complete rules of the Game (hereinafter, the “Rules”) can be consulted free of charge on the Site for the entire Duration of the Game.

It is also available free of charge to anyone who requests it from the Organizing Company at the following address: hello@thebradery.com 

Article 3: Participation

Participation in the Game implies unreserved acceptance and compliance with the provisions of the Rules.

The Game is not managed or sponsored by Facebook. The information you provide is provided and used solely by the Organizing Company, not by Facebook.

The Game is not administered or sponsored by Apple. The information you provide is provided and used solely by the Organizing Company, and not by Apple.
No Apple products are at stake in the Game.

By participating in the game, you accept the data protection regulations and you agree to receive newsletters from The Bradery.

3.1 Conditions of participation in the Game

Only individuals residing in mainland France may participate in the Game, excluding staff of the Organizing Company and that of companies having participated in the preparation of the Game and members of their close family (parents, brothers and sisters, or any other person residing in the same household).

Any participant under the age of 18 and/or lacking legal capacity must obtain prior authorization from a parent or guardian to participate in the Game and accept the Rules.

The Organizing Company may at any time ask any minor or assisted participant to provide proof of this authorization and, where applicable, disqualify a participant who cannot provide proof of this authorization. Participation in the Game is limited to one person per entry (same surname, same first name, same email address and Facebook ID) unless the Game is shared as indicated in clause 4.2. Any additional participation will be considered null and void.

To participate, it is mandatory to use a valid personal email address.

3.2 Validity of participation

The Organizing Company reserves the right to verify that participants have participated in the Game under conditions that comply with the Rules. Non-compliant participation will result in the disqualification of participants and the loss of points.

These different situations will result in the immediate disqualification of participants:

• Multiple entries using non-existent email addresses or those linked to the same person.

The Organizing Company may cancel all or part of the Game if it appears that fraud has occurred in any form whatsoever, particularly by computer, in the context of participation in the Game. In this case, it reserves the right not to award prizes to the fraudsters and/or to prosecute the perpetrators of such fraud before the competent courts.

It is expressly agreed that the Organizing Company may use programs, data, files, recordings, operations and other elements in computer or electronic format or media, in particular for the purpose of proving any breach by participants of the provisions of the Regulations.

Article 4: Game progress

4.1. In order to validate their participation, participants must provide their email address, accept the conditions of participation, and validate their participation.

4.2. In order to participate in the Game, participants must, during the Duration of the Game, proceed as follows:

- Go to the Site and access the Game page

- Fill in their email address

- Click on “I’M PARTICIPATING”

- The vouchers will be delivered at the end of the Game Period, on 01/12/2023 by email. The email may be sent to spam.

A winner will be drawn on Friday 01/12/2023 and contacted immediately by email. If there is no response within 1 week after the email is sent, another person will be drawn.

- Any inaccurate or incomplete registration will not be taken into account and may result in the participation being invalid. In particular, registrations with inaccurate, fanciful or incomplete contact details or those that do not comply with the provisions of the Rules, or those sent after the end of the Game Period, may not be taken into consideration.

It is strictly forbidden for a participant to participate in the Game from another person's email address.

Article 5: Allocations

5.1. List of prizes in play at the end of the Game Duration

Vouchers sent to people who have acquired the necessary number of points according to the following conditions:

20€ voucher minimum purchase of 60€ = 3 points = 3 friends registered using their own link

40€ voucher minimum purchase of 100€ = 5 points = 5 friends thanks to its own link

60€ voucher minimum purchase of 150€ = 20 points = 20 friends thanks to its own link

5.2. Prizes may not be exchanged or subject to payment of their cash value and may not be awarded in any form other than that provided for in the Regulations.

Article 6: Award of prizes

Any prize that cannot be awarded, due to an error or omission in the participants' contact details, a change in their contact details or an unsubscription to The Bradery newsletter, in the event of failure to claim the prize within the time limit or for any other reason attributable to the winners, and any prize not claimed by the winners within the time limit will be considered lost and will not be put back into play. The prize may not under any circumstances be claimed subsequently by the initial winner.

Article 7: Data protection and freedoms

7.1. Personal information concerning participants in the Game is intended for use by the Organizing Company for the purposes of the Game, in particular its organization, the production of participation statistics, the taking into account of the participant's participation and the sending of prizes.

Personal information that must be provided as part of the Game is identified by an asterisk on the Game collection form. Failure to provide this mandatory information will result in the participant's participation not being taken into account.

7.2. Under no circumstances will this information be retained at the end of the Game unless the participant consents to receive commercial offers on the products and services of the Organizing Company.

In application of law n° 78-17 of January 6, 1978 relating to information technology, files and freedoms, participants and their legal representatives have the right to access, rectify and delete data concerning participants as well as a right of opposition for legitimate reasons and opposition to prospecting, in particular commercial.

7.3. Through this game, each participant who clicked on "I'M PARTICIPATING" on the registration form will receive emails from the Organizing Company 1 and 2 about new products, offers and news about the brand. Article 8: Liability

8.1. Participation in the Game via the Internet implies knowledge and acceptance of the characteristics and limitations of the Internet, in particular with regard to technical performance, response time for consulting, querying or transferring information. The absence protection of certain data against possible misappropriation and the risks of contamination by possible viruses circulating on the network, cannot under any circumstances lead to the Organizing Company being held liable.

As such, the Organizing Company cannot be held responsible in the event of interruption of Internet communications or alteration of participations (network communication, network interruption) and more generally, of any malfunction of the Internet network, of all or part of the Site or of any other technical connection, over which the Organizing Company has no control. In particular, the Organizing Company or its service providers decline all responsibility in the event that the Site is unavailable during the duration of the Game, for a reason that is not attributable to them.

Similarly, the Organizing Company cannot be held responsible for delays or errors in the transmission of e-mail beyond its control and declines all responsibility in the event of misuse of the device used to access the Game or of an incident linked to the use of this device (more specifically, the Organizing Company cannot be held responsible for any damage, material or immaterial, caused to participants, to their computer equipment and to the data stored therein, and for the consequences that may result from this on their personal, professional or commercial activity).

8.2. The Organizing Company shall not be held liable in the event of an error in the delivery of the prize due to incorrect information provided by the winner.

8.3. The Organizing Company shall not incur any liability if, in the event of force majeure, it were to cancel this Game, to terminate it, extend it, postpone it or modify its conditions, and its liability shall not be incurred as a result.

Article 9: Reimbursement of internet connection costs

No financial compensation or expense in any form whatsoever will be granted to participants as a result of their participation.

Article 10: Intellectual property / Image rights

The images used on the Site, the objects represented, the brands and trade names mentioned, the graphic and computer elements and the databases making up the Site, are the exclusive property of their respective owners and may not be extracted, reproduced, represented or exploited without the written authorization of the latter, under penalty of civil and/or criminal prosecution.

All trademarks or product names mentioned are registered trademarks or product names of their respective owners.

Article 11: Disputes – applicable law

The Game and the Rules are subject to French law, without prejudice to the public policy provisions applicable in the participant's country of residence.

Any dispute arising in connection with this Game will be submitted to the competent French courts without prejudice to the public policy provisions applicable in the participant's country of residence.
